Acknowledgment and acceptance of terms and conditions
The Circus Oz website is owned and operated by Circus Australia Ltd (ABN: 43 005 412 788). By browsing or purchasing from this website, you agree to be bound by these Terms and Conditions as amended from time to time.

All classes or merchandise offered on our website are subject to availability. If a class is full or merchandise is temporarily out of stock it will be noted on the product page. No orders can be taken for full classes or out of stock items so please check back regularly for availability.

We will accept your order by sending you an email confirming receipt and listing the details of your order. An order will not be complete or binding until you receive an email from us confirming receipt.

Pricing information
Goods and services provided through this website attract the Australian Federal Government Goods and Services Tax (GST) of 10%. All prices listed on this website (including prices listed for services, products and product postage and handling) are inclusive of GST. The total GST paid is included in the final price on the Tax Invoice.

All monetary values shown on this site are Australian Dollars (AUD).

Please note international orders may attract additional fees charged by your credit card provider for currency exchange.

Circus Oz online class refund policy
If you have paid for a whole term or holiday program, a full refund will only be given up to 14-days prior to the first class commencement date. No refunds will be given past this point.

Refund requests can be made by either sending an email to classes@circusoz.com.au or by calling 03 9676 0325. An administration fee of $30 will be deducted from the price paid for the class.

Circus Oz missed class policy
We do not refund, credit, run additional classes or allow people to join other classes to make up for any individual classes they have missed. Classes will run whether you attend or not, it is your responsibility to make sure you can attend all the classes within the term.

Training programs enrolment information

All classes are subject to a minimum and maximum number of participants and Circus Oz reserves the right to reject your application to enroll in one of its classes.

In the event a class is cancelled or the dates of a class are altered for any reason you can choose to:

-attend the rescheduled class (if applicable);
-request a credit note; or
-request a full refund.

Circus Oz reserves the right to substitute teachers advertised for classes at its discretion, subject to the replacement teacher being qualified and skilled at a level required to take the relevant class.

Indemnity Conditions

All participants in Circus Oz classes and workshops are required to give consent before commencing training. This is part of the online enrolment process and generally there is no separate consent form. Individuals and Parent/ Guardians are required to tick that they agree to the Terms and Conditions and the Circus Oz Indemnity Conditions. By agreeing to these online, your consent is recorded.

Delivery of merchandise
Merchandise delivered within Australia are sent via standard post. Goods delivered internationally are sent via standard airmail.

Select the appropriate postage and handling cost from the pull down menu at check out. Incorrect selection will result in a delay in processing your order.

Return of merchandise policy
You may return or exchange any product purchased via this website by sending an email within 14-days of delivery to merchandise@circusoz.com.au. Your email should detail the following:

- your order number and item name;
-the reason for its return; and
-your request for refund or exchange.

Please include a daytime telephone number so we can contact you if required.

Do not return your purchased goods until we have approved return.

Refunds will be for the cost of the product only (i.e excluding postage and handling costs).

Goods returned (including packaging where applicable) must be returned in their original condition.

Returned goods should be sent via registered mail. Customers will not be responsible for shipping and handling charges for return of faulty or damaged products.

We endeavour to process returns within 10-14 days.

General disclaimers
Use of this website is at your risk.

To the maximum extent permitted by law, none of Circus Australia Ltd, or any of their respective employees, makes any express or implied representation or warranty about, or will be liable to you or any other person for any loss or damage (whether direct, indirect, consequential or economic), however caused and whether by negligence or otherwise, in connection with, this website, its use, its content or any products or services referred to on this website.

This includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:

(a) your reliance on the completeness, accuracy, suitability or currency of the website or its content;

(b) failure or delay of performance or in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records; and

(c) defamatory, threatening, offensive or unlawful conduct of third parties.

Circus Australia Ltd does not represent that any information (including any file) obtained from or through this website is free from computer viruses or other faults or defects. It is your responsibility to scan any such information for computer viruses.

Circus Oz warrants to the customer that products supplied via this website will be:

(a) of merchantable quality; and

(b) fit for their intended purpose.

Apart from the warranties given at (a) and (b) above no other warranties are given or implied by Circus Australia Ltd in connection with products supplied via this website.

Nothing in these conditions is intended to exclude, restrict or modify any warranty concerning the sale of goods implied at law including those set out in the Trade Practices Act (Cth) (“Implied Warranty”).

If Circus Oz is found to have breached an Implied Warranty, Circus Oz’s liability to the customer will be expressly limited to any one or more of the following:

(a) the replacement of product concerned; or

(b) the payment of the cost of replacing the product concerned.
